General Terms and Conditions

This Application collects some Personal Data from its Users. This document can be printed for reference by using the print command in the settings of any browser.

Vokabl offers information and materials about language learning, as well as paid online language courses as part of its service (hereinafter referred to as the "Service"). The Service is offered via the website www.vokabl.com and related sub-domains.

These General Terms and Conditions ("GTC") govern the contractual relationship between Vokabl and users of the Service ("Users"). Deviating terms and conditions of the User are not recognised unless Vokabl expressly agrees to their validity in writing.

The term "Materials" refers to any content, resources, exercises, videos, audio files, or other educational materials made available through the Service. The term "Service" refers to the entirety of language learning offerings provided by Vokabl, including but not limited to online courses, learning platforms, and supplementary materials.

In order to use the Service, Users must register for a user account. Registration is available to natural persons who are at least 18 years of age. Minors may only register with the express consent of their legal guardian.

Registration can be completed via the following methods:

  • Direct registration using email address and password
  • Single Sign-On (SSO) via Google
  • Single Sign-On (SSO) via Facebook

By completing the registration process, the User submits an offer to conclude a contract for the use of the Service. Vokabl accepts this offer by activating the user account or by confirming registration via email.

When placing an order for paid services, the User selects the desired product, enters payment information, and submits the order by clicking the "Buy Now" or equivalent button. The contract for the paid service is concluded upon Vokabl's order confirmation.

All content, Materials, and software provided through the Service are protected by copyright and other intellectual property rights. Vokabl grants the User a non-exclusive, non-transferable, revocable licence to use the Materials solely for personal, non-commercial educational purposes during the term of the agreement.

The User is expressly prohibited from:

  • Reproducing, distributing, or publicly making available any Materials in whole or in part
  • Modifying, creating derivative works of, or reverse-engineering any content or software
  • Recording, screen-capturing, or otherwise copying live lessons or video content
  • Sharing account credentials or allowing third parties to access the Service through the User's account
  • Using the Materials for any commercial purpose, including resale or sublicensing

Any unauthorised use of the Materials constitutes a breach of these GTC and may result in the immediate termination of the User's account and legal action.

The User's access to the Service is personal and non-transferable. The User is responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

The User agrees to:

  • Keep their login credentials confidential and not share them with third parties
  • Notify Vokabl immediately of any unauthorised use of their account or any other breach of security
  • Provide accurate and complete information during registration and keep it up to date
  • Use the Service in compliance with all applicable laws and regulations

Vokabl is not obligated to log or monitor User data or activities beyond what is required by law. Vokabl reserves the right to temporarily interrupt the Service for maintenance, updates, or other operational reasons. Vokabl will make reasonable efforts to minimise disruptions and to notify Users in advance of planned interruptions where possible.

Live language lessons are conducted via video conferencing tools integrated into the Service. Lessons are booked on a credit basis — Users purchase lesson credits which can then be redeemed for individual or group sessions.

Scheduling and Cancellation

  • Users may schedule, reschedule, or cancel lessons through their account dashboard.
  • Cancellations must be made at least 72 hours before the scheduled lesson start time to receive a full credit refund.
  • Cancellations made less than 72 hours before the lesson will result in the forfeiture of the lesson credit.

Late Arrival Policy

  • If a User arrives more than 10 minutes late to a scheduled lesson, the tutor may end the session, and the lesson credit will not be refunded.
  • If a tutor is late, the lesson will be extended accordingly or the User may request a reschedule at no cost.

Technical Requirements

Users are responsible for ensuring they have a stable internet connection, a working microphone, and a camera (if required) for video lessons. Vokabl is not liable for lesson disruptions caused by the User's equipment or connection issues.

The prices for all paid services are displayed on the Vokabl website and are inclusive of applicable statutory value-added tax (VAT) unless stated otherwise.

Payment is due immediately upon completion of the order. The following payment methods are accepted:

  • Credit card (via Stripe)
  • PayPal
  • Other methods as displayed at checkout

In the event of default, the User shall be charged default interest at a rate of 5 percentage points above the base rate of the European Central Bank. Vokabl reserves the right to claim further damages caused by default.

Subscriptions

Certain services may be offered on a subscription basis. Subscriptions automatically renew at the end of each billing period unless cancelled by the User before the renewal date. Users can manage their subscription and cancellation through their account settings.

If you are a consumer within the European Union, you have the right to withdraw from a contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform Vokabl of your decision to withdraw by an unequivocal statement (e.g., a letter sent by post or email). You may use the model withdrawal form provided in Section 11 of these GTC, but it is not obligatory.

Reimbursement: If you withdraw from the contract, Vokabl shall reimburse all payments received from you without undue delay and in any event not later than 14 days from the day on which Vokabl is informed of your decision to withdraw. The reimbursement will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.

Exclusions: The right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.

Vokabl will provide the Service with reasonable care and skill. However, Vokabl does not warrant or guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The Service will meet the User's specific requirements or expectations
  • The results obtained from the use of the Service will be accurate or reliable
  • The Service will be compatible with all devices, operating systems, or browsers
  • Any errors in the Service will be corrected within a specific timeframe

The Materials are provided for general educational purposes and do not constitute professional advice. Vokabl makes no representations as to the suitability of the Materials for any particular purpose.

Unlimited liability: Vokabl shall be liable without limitation for damages resulting from injury to life, body, or health caused by a negligent or intentional breach of duty by Vokabl, its legal representatives, or its vicarious agents. Vokabl shall also be liable without limitation in cases of intentional misconduct.

Limited liability for slight negligence: In cases of slight negligence, Vokabl shall only be liable for breaches of material contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable, typically occurring damages. A cardinal obligation is an obligation whose fulfilment is essential for the proper performance of the contract and on whose compliance the User may regularly rely.

Further exclusions: Vokabl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • The User's access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorised access, use, or alteration of the User's transmissions or content

Vokabl processes personal data in compliance with the General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and the German Telemedia Act (TMG) as applicable.

Personal data is collected, processed, and used only with the User's consent or where permitted by law. Data is collected and processed for the purpose of providing and improving the Service, processing payments, and communicating with Users.

Vokabl will not disclose personal data to third parties except where necessary for the performance of the contract (e.g., payment processors), where required by law, or where the User has given their explicit consent.
